Do I Need a BASIX Certificate? A Guide for NSW Homeowners

If you are planning a residential project in New South Wales, understanding your compliance requirements is the essential first step. 

Many property owners ask, "Do I need a BASIX certificate?" and the answer depends on the scope and cost of your project.  The Building Sustainability Index (BASIX) is a mandatory NSW Government initiative designed to ensure homes are energy- and water-efficient, providing long-term comfort and reduced utility bills for occupants.  

When Is a BASIX Certificate Mandatory?

You generally need a BASIX certificate if your project falls into one of the following three categories:

1. New Residential Dwellings

A BASIX certificate is required for all new residential developments. This includes:  Detached houses and "knockdown-rebuild" projects.  Dual occupancies, duplexes, townhouses, and terraces.  Residential flat buildings and apartments.  Secondary dwellings (granny flats).  

2. Alterations and Additions

If you are renovating an existing home, a BASIX certificate is triggered when the estimated development cost is $50,000 or more.  This applies to major internal renovations, second-storey additions, ground-floor extensions, and combined kitchen/bathroom works.  

3. Swimming Pools and Spas

A BASIX certificate is required if you are installing a swimming pool or outdoor spa with a capacity of 40,000 litres or more.  Note: If you are building both a pool and a spa, their combined capacity is used to determine if the threshold is met.  

Common Exemptions

Not every project requires a certificate. You may be exempt if:

• Minor Renovations: Your alterations and additions cost less than $50,000.  
• Small Pools/Spas: The water capacity is under 40,000 litres.  
• Non-Residential Buildings: Commercial, industrial, and retail developments are subject to different standards (e.g., NCC Section J).  
• Large Boarding Houses: Certain large boarding houses, hostels, or co-living housing (accommodating more than 12 residents or exceeding 300m² in gross floor area) are exempt.  
• Tiny Homes on Wheels: If the structure remains mobile and is not permanently fixed to the land, it is typically classified as a caravan rather than a building.  

How to Get Your Certificate

If your project triggers a BASIX requirement, you must submit a valid certificate with your Development Application (DA) or Complying Development Certificate (CDC).  

• Assess Your Design: Use the online BASIX assessment tool to input project details, including floor area, window types, insulation, and water systems.  
• Achieve Targets: The tool determines if your design meets the NSW Government's water, energy, and thermal comfort benchmarks.  
• Generate Certificate: Once compliant, you pay the required fee to generate your certificate.  Commitment: Your builder must follow the "sustainability commitments" listed on the certificate (e.g., specific tap fittings or insulation R-values) to receive an Occupation Certificate.
